About these terms

By placing an order or commissioning a piece on madelynbickel.com, you agree to these terms. They cover original paintings, prints, and commissions sold by Madelyn Bickel ("I," "me," "my") through this website and any linked checkout.

Please read them before you buy. If you have questions, email me at madinmaking@gmail.com before placing your order and I'm happy to help.

Artwork and product details

Every piece is made by hand, so small differences from the photos are part of the work, not a defect.

  • Color: I photograph my work as accurately as I can, but colors look different across screens and lighting. Slight variation in color or texture is not grounds for a return.

  • Originals: Each original painting is one of a kind. Oil and acrylic paintings may show brushstrokes, raised texture, or small irregularities that are part of the piece.

  • Prints: Prints are reproductions of original paintings. Paper texture, borders, and print size are listed on each product page. Prints may vary slightly from batch to batch.

  • Framing: Unless a listing says otherwise, work ships unframed. Frames shown in photos are for display only.

  • Care: Keep work out of direct sunlight and away from moisture. I'm not responsible for damage that happens after delivery, including fading, warping, or damage from handling or framing.

Orders and payment

Your order is confirmed once payment goes through and you receive a confirmation email.

  • Prices are listed in US dollars and can change at any time. The price you pay is the price shown at checkout.

  • Availability: Originals are one of a kind. If two people buy the same piece at the same time, the first completed payment gets it and the other order is fully refunded.

  • Errors: If a listing has a pricing or description mistake, I may cancel the order and issue a full refund.

  • Right to cancel: I may cancel any order for any reason before it ships, with a full refund.

  • Taxes: Sales tax is added at checkout where required by law.

Shipping

Shipping times are estimates only. They are not guaranteed and are not binding.

  • Processing time: Orders usually ship within 5-7 business days. Original paintings may need extra time to dry, varnish, or pack safely. Some originals also require specialty shipping materials to be ordered, which can add to the time before they ship.

  • Delays: Once a package leaves my hands, delivery depends on the carrier. Delays from carriers, weather, holidays, customs, strikes, or other events outside my control can happen, and I'm not responsible for them. A delay is not grounds for a refund or cancellation.

  • Tracking: You'll get a tracking number when your order ships. Please use it to follow your package. This does not apply to items mailed with regular USPS stamps or postage, such as the fish bookmarks. These do not have tracking.

  • Address accuracy: Please double check your shipping address at checkout. I'm not responsible for orders sent to an incorrect address you entered. If a package is returned to me, you'll need to pay shipping again to resend it.

  • Lost or stolen packages: Once tracking shows a package as delivered, I'm not responsible for loss or theft. If tracking stalls for more than 7 business days, contact me and I'll open a claim with the carrier and help however I can.

  • Shipping insurance: Original paintings ship with insurance. If you choose not to add insurance, I can't replace or refund items lost or damaged in transit.

  • International orders: Customs duties, import taxes, and brokerage fees are the buyer's responsibility and are not included in the price. Packages refused or unclaimed because of these fees will not be refunded.

Returns and refunds

All sales of original paintings are final. I do not accept returns or offer refunds on original artwork.

  • Prints: Unused prints in their original packaging can be returned within 14 days of delivery for a refund minus shipping. The buyer pays return shipping.

  • Commissions and custom work are final sale. See the Commissions section below.

  • Damaged in transit: If your order arrives damaged, email me within 48 hours of delivery at madinmaking@gmail.com with photos of the artwork, the packaging, and the shipping label. Keep all packaging until the issue is resolved, since carriers often require it for claims. Once the claim is reviewed, I'll offer a replacement print, a repair, or a refund, at my discretion.

  • Wrong item: If I send the wrong item, I'll make it right at no cost to you.

  • Change of mind: I can't accept returns because you changed your mind, the piece didn't fit your space, or the color looks different than it did on screen.

Commissions

Commissions start once the deposit is paid, and the deposit is non-refundable.

  1. Request: Submit the commission form with your reference photos, size, and any details. Submitting the form does not guarantee I'll take the project.

  2. Deposit: If I accept, a non-refundable deposit of 50% is due to reserve your spot. It covers my time, planning, and materials.

  3. Reference photos: You confirm you own or have permission to use any photos you send me.

  4. Creative freedom: Commissions are my interpretation of your request in my own style. Small differences from the reference are part of the process.

  5. Revisions: I'll share progress at the sketch and color study stages. Changes requested at those stages are included. Major changes after painting begins may cost extra or may not be possible.

  6. Timeline: Estimated completion times are not guaranteed. I'll keep you updated if anything shifts.

  7. Final payment: The remaining balance is due before the finished piece ships.

  8. Cancellation: If you cancel, the deposit is kept. If you cancel after painting has started, payment for work completed so far may be due. If I need to cancel, I'll refund any money you've paid.

  9. Unpaid balances: If the final payment isn't made within 14 days of completion, I may keep the deposit and sell or keep the work.

Copyright and use of my artwork

Buying a painting or print gives you the physical piece, not the copyright. I keep all rights to my images, including commissioned work.

  • You may not copy, reproduce, print, or sell my artwork or images of it, including on merchandise, without my written permission.

  • You may not use my artwork or images of it to train AI models or create AI-generated work.

  • You're welcome to share photos of your piece on social media with credit to @madinthemaking.

  • I may share photos of commissioned work on my website and social media. If you'd like your commission kept private, let me know before the work begins.

Disputes, liability, and changes

If something goes wrong, please contact me first. Most issues can be fixed with one email.

  • Chargebacks: Please reach out before filing a dispute with your bank or card company. Filing a chargeback without contacting me first, or for a final sale item that was delivered as described, may be contested with order records, tracking, and our messages.

  • Limit of liability: My responsibility for any order is limited to the amount you paid for it.

  • Privacy: I only use your personal information to process and ship your order and to contact you about it. I don't sell your information.

  • Governing law: These terms are governed by the laws of the State of New York.

  • Changes: I may update these terms from time to time. The version posted when you place your order is the one that applies.
